SEDA-Group ("SEDA," "we," "us," or "our") respects the privacy and confidentiality of information processed through the xOptim® software suite ("xOptim®" or the "Software").

xOptim® is a software suite developed by SEDA Group for engineering, energy, drilling, fluid modeling, production prediction, artificial intelligence (AI), machine learning (ML), and related analytical applications.

This Privacy Policy describes how information is handled depending on the deployment and use of xOptim®.

1. Scope

This Privacy Policy applies to the xOptim® software suite and distinguishes between:

  1. Desktop/local deployments, where xOptim® operates on the user's or customer's computer or computing environment; and
  2. Web-based deployments, where xOptim® is accessed through a web browser and may require user authentication or other server-based services.

The information processed by xOptim® depends on the deployment model and the configuration agreed upon with the customer.

Where a customer has entered into a separate software license, service agreement, data-processing agreement, or other written agreement with SEDA, the specific terms of that agreement may supplement or govern the handling of customer information.

2. Desktop / Local xOptim® Software

The desktop versions of xOptim® are designed to operate locally on the user's or customer's computing environment.

For standard desktop deployments:

  • SEDA does not collect users' names or email addresses through the Software.
  • SEDA does not collect users' personal information through the Software.
  • SEDA does not routinely collect user activity or usage telemetry through the Software.
  • Engineering, operational, scientific, and technical data processed by the desktop application remains within the user's or customer's computing environment unless the user or customer independently chooses to transmit information to SEDA, for example for technical support.
  • SEDA does not have automatic access to files or engineering data processed locally by the desktop application.

Accordingly, customers using a standard local desktop deployment can operate xOptim® without routinely transmitting their engineering data or personal information to SEDA.

If a particular customer deployment includes a separate licensing, update, support, cloud, or integration service that transmits information to SEDA or a service provider, the applicable service arrangement will identify the relevant information and processing.

3. Web-Based xOptim®

Web-based versions of xOptim® operate through a web browser and may require limited information to provide authenticated and secure access to the Software.

Depending on the customer's configuration, this may include:

  • User name;
  • Business or institutional email address;
  • Organization or institution;
  • Account and authentication information;
  • User permissions and access roles; and
  • Information necessary to maintain the security and operation of the service.

The specific information collected or processed depends on the web deployment and authentication configuration.

SEDA seeks to limit the collection of personal information to information reasonably necessary to provide and secure the web-based service.

4. Customer Engineering and Technical Data

xOptim® (web-based) may be used to process customer-provided technical information, including, for example:

  • Well data;
  • Drilling data;
  • Drilling-fluid and mud data;
  • Formation and geological data;
  • Pressure and temperature data;
  • Well trajectory and directional data;
  • Reservoir data;
  • Production data;
  • Engineering parameters;
  • Simulation data;
  • AI/ML inputs and outputs;
  • Engineering models and calculations;
  • Reports and technical files; and
  • Other proprietary technical or operational information.

This information is referred to as "Customer Data."

Customer Data remains subject to the applicable license, service, confidentiality, or other agreement between SEDA and the customer.

SEDA does not sell Customer Data.

SEDA does not disclose Customer Data to third parties for their independent commercial use except where authorized by the customer, required to provide an agreed service, or required by applicable law.

5. Use of Customer Data

SEDA processes Customer Data only as reasonably necessary to provide the xOptim® functionality and services requested by the customer.

Depending on the deployment, Customer Data may be processed to:

  • Perform engineering calculations;
  • Execute simulations;
  • Generate analytical results;
  • Perform AI/ML-based predictions;
  • Optimize engineering workflows;
  • Generate reports and visualizations;
  • Provide technical support requested by the customer;
  • Maintain and secure the Software; and
  • Fulfill contractual or legal obligations.

For standard desktop deployments, Customer Data remains within the customer's computing environment unless the customer chooses to provide data to SEDA.

For web-based deployments, Customer Data may be transmitted to and processed by the systems supporting the web-based xOptim® service.

6. AI and Machine Learning

xOptim® incorporates AI and machine-learning technologies for applications such as prediction, classification, optimization, modeling, and engineering analytics.

Customer Data submitted to xOptim® is processed to provide the AI/ML functionality requested by the customer.

SEDA does not use a customer's confidential Customer Data to train general-purpose AI or machine-learning models for unrelated customers or third parties unless the customer has expressly authorized such use.

SEDA may develop and improve general engineering methodologies, algorithms, and software functionality using its own development data, publicly available information, appropriately licensed data, synthetic data, or aggregated/de-identified information where appropriate.

7. Confidentiality of Customer Information

SEDA recognizes that xOptim® may be used to process confidential engineering, scientific, operational, commercial, and research information.

SEDA treats Customer Data as confidential information in accordance with applicable contractual obligations.

SEDA does not claim ownership of a customer's underlying engineering or operational data merely because that data is processed by xOptim®.

Customers retain their rights in their own data and are responsible for ensuring that they have the necessary rights and permissions to provide data to xOptim®.

8. Information Security

SEDA uses reasonable technical and organizational measures appropriate to the nature of the information and the applicable deployment to protect information against unauthorized access, alteration, disclosure, or destruction.

For desktop deployments, protection of locally stored Customer Data is primarily provided through the customer's own computing environment, operating-system security, access controls, network security, and organizational security procedures.

For web-based deployments, SEDA applies appropriate security controls to the systems supporting the service.

Specific security controls may vary depending on the deployment architecture and customer requirements.

No electronic system can be guaranteed to be completely secure. Customers should maintain appropriate security controls and backups for information stored within their own environments.

9. Data Hosting and Storage

Desktop Deployment

Standard desktop versions of xOptim® do not require SEDA to host or store the customer's engineering data.

Data generated or processed by the desktop application remains in the customer's computing environment unless the customer voluntarily transfers information to SEDA or another authorized service.

Web Deployment

Web-based xOptim® may require information and Customer Data to be stored or processed on servers or cloud infrastructure supporting the service.

The applicable hosting environment may depend on the customer's deployment and contractual requirements.

Where relevant, hosting and data-location arrangements may be specified in the applicable agreement or implementation documentation.

10. Data Retention and Deletion

For desktop deployments, SEDA generally does not retain Customer Data because the data is maintained within the customer's own computing environment.

For web-based deployments, retention and deletion of Customer Data will depend on the applicable service configuration and contractual arrangements.

Upon termination of a web-based service, Customer Data may be deleted or returned in accordance with the applicable agreement, subject to reasonable backup-retention periods and legal requirements.

Customers may contact SEDA regarding applicable data-retention and deletion procedures.

11. Sharing of Information

SEDA does not sell personal information or Customer Data.

Information may be disclosed where reasonably necessary:

  • To provide an agreed xOptim® service;
  • To authorized SEDA personnel;
  • To service providers supporting the operation of a web-based xOptim® service;
  • To address security or technical issues;
  • To comply with applicable legal requirements; or
  • With the customer's authorization.

Where third parties process Customer Data on behalf of SEDA, SEDA seeks to require appropriate confidentiality and security obligations consistent with the applicable service.

12. Cookies and Web Technologies

Standard desktop versions of xOptim® do not use web-browser cookies for the purpose of collecting user information.

Web-based xOptim® may use session technologies, cookies, or similar mechanisms when necessary for functions such as:

  • Authentication;
  • Maintaining a secure user session;
  • User preferences;
  • Security; and
  • Operation of the web application.

The specific technologies used depend on the web deployment.

13. Third-Party Services

Certain web-based xOptim® deployments may use third-party infrastructure or technical services necessary to operate, secure, host, authenticate, or maintain the Software.

The use of such services depends on the deployment configuration and applicable customer agreement.

SEDA does not authorize third parties to use Customer Data for independent commercial purposes unless expressly agreed with the customer.

14. Academic and Research Use

xOptim® may be used by universities, research institutions, faculty, students, researchers, and other academic users.

SEDA recognizes that academic and research customers may process confidential research information, intellectual property, and institutional data through xOptim®.

Customers and institutions remain responsible for ensuring that their use of xOptim® complies with applicable institutional policies, research requirements, confidentiality obligations, and applicable laws.

For desktop deployments, research and engineering data can remain entirely within the institution's computing environment.

15. Personal Information

xOptim® is primarily an engineering and analytical software platform and is not designed to require extensive personal information.

For standard desktop deployments, SEDA does not collect personal information through the Software.

For web-based deployments, limited personal information may be processed where necessary for account administration, authentication, access control, security, and operation of the service.

Users should avoid entering unnecessary personal or sensitive information into engineering datasets processed by xOptim®.

16. Children's Privacy

xOptim® is primarily intended for professional, academic, research, institutional, and engineering users.

SEDA does not knowingly seek to collect personal information from children through xOptim®.

Where xOptim® is used by an educational institution, the institution is responsible for ensuring that its use of the Software complies with applicable requirements concerning students and minors.

17. Privacy Rights and Requests

Depending on applicable law, individuals may have rights regarding personal information processed through web-based xOptim®, including rights to request access, correction, deletion, restriction, or other legally available remedies.

Because the nature of data processing varies between desktop and web deployments, privacy requests will be evaluated according to the applicable deployment and legal requirements.

18. Security Incidents

If SEDA becomes aware of a security incident involving Customer Data that requires notification under applicable law or a customer agreement, SEDA will follow the applicable notification and response requirements.

Where appropriate, SEDA will cooperate with the affected customer in investigating and addressing the incident.

19. Customer Responsibilities

Customers are responsible for:

  • Maintaining appropriate access controls;
  • Protecting their computer systems and user credentials;
  • Ensuring that users are authorized to access Customer Data;
  • Ensuring that data submitted to xOptim® may legally be processed;
  • Maintaining appropriate backups for locally stored information;
  • Complying with applicable institutional and legal requirements; and
  • Avoiding unnecessary inclusion of personal or sensitive information in engineering datasets.

20. Changes to This Privacy Policy

SEDA may periodically update this Privacy Policy to reflect changes to xOptim®, its deployment models, applicable laws, or privacy and security practices.

The most current version will be made available through the SEDA Group website.

The "Last Updated" date at the beginning of this document identifies the date of the most recent revision.

22. Relationship to Customer Agreements

This Privacy Policy should be read together with any applicable xOptim® license agreement, subscription agreement, services agreement, confidentiality agreement, data-processing agreement, or other written agreement between SEDA and the customer.

Where an applicable written agreement contains specific provisions governing Customer Data or privacy, those provisions will control to the extent of any conflict with this Privacy Policy.
